Insolvency law
From the beginning Müller-Heydenreich Beutler & Kollegen has specialized in insolvency law, especially in the form of insolvency administration. Six insolvency administrators are appointed by the local courts of Munich, Rosenheim, Memmingen, Weilheim, Landshut, Augsburg and Meiningen.
The firm's main objective is to ensure the continued existence of insolvent businesses. The MHBK administrators attempt if possible to avoid a break-up. This secures higher recovery rates for creditors and helps to preserve jobs. In many cases, MHBK has achieved high, above-average recovery rates for creditors (e.g. more than 60 per cent in the case of the clothing company Trumpf Blusen-Kleider GmbH & Co. KG; and some 58 per cent in the case of Südbayerische Betonpumpen-Verleih GmbH & Co. KG).
The insolvency administrators of MHBK have successfully applied all the available forms of reorganization (insolvency plan, asset-deal reorganization, mixed forms). Besides business continuations, the firm has particular strengths in insolvency plan proceedings and cross-border insolvencies.
We place great emphasis on ensuring that all the parties involved in the reorganization process work well together and that their respective interests are taken into account (employees, suppliers, creditors, banks and shareholders). Speed, transparency and communications are very important for the MHBK administrators in the reorganization process.
The administrators are supported by well trained, experienced internal staff and advisers who have been with the firm many years. The litigation department, which consists of four attorneys, and Thomas E. Funk, an attorney specialising in employment law, provide assistance in the proceedings.

To avoid conflicts of interest, the firm provides no advice prior to an insolvency. The firm also always takes care to comply with the principles of the VID and the Uhlenbruck Commission.
